3.1. Scope of personal data processing

As a general rule, we process our users’ personal data only to the extent necessary to provide a fully functional website and our content and services. The processing of our users’ personal data is, as a general rule, carried out only with the user’s consent. An exception applies in cases where it is not possible, for practical reasons, to obtain consent in advance and where the processing of the data is permitted by statutory provisions. Personal data is only disclosed to third parties within the framework of a contractually secured data processing arrangement with our internal companies within the Gleich Group and with the IT service providers we have commissioned. GLEICH Aluminium GmbH remains responsible for this data.

3.2. Legal basis for the processing of personal data

Where we obtain the data subject’s consent for the processing of personal data, Article 6(1)(a) of the EU General Data Protection Regulation (GDPR) serves as the legal basis.

Where the processing of personal data is necessary for the performance of a contract to which the data subject is a party, Article 6(1)(b) of the GDPR serves as the legal basis. This also applies to processing operations necessary for the implementation of pre-contractual measures.

Where the processing of personal data is necessary for compliance with a legal obligation to which our company is subject, Article 6(1)(c) of the GDPR serves as the legal basis.

Where the processing of personal data is necessary to protect the vital interests of the data subject or of another natural person, Article 6(1)(d) of the GDPR serves as the legal basis.

Where processing is necessary to safeguard a legitimate interest of our company or a third party, and the interests, fundamental rights and freedoms of the data subject do not override the former interest, Article 6(1)(f) of the GDPR serves as the legal basis for the processing.

3.3 Data erasure and retention period

The data subject’s personal data will be erased or restricted as soon as the purpose for which it was stored no longer applies. Data may also be stored if this is provided for by European or national legislation in EU regulations, laws or other provisions to which the controller is subject. Data will also be blocked or deleted when a retention period prescribed by the aforementioned standards expires, unless there is a need to continue storing the data for the conclusion or performance of a contract.

Where our digital services offer the option to provide personal data, we ask that you consider for yourself which data you wish to disclose to us. We require the mandatory fields, marked as such, to process your enquiry or order. Any additional data collected is provided on a voluntary basis and is used to optimise our services and, where applicable, for statistical purposes.

4.1. Webhosting

We host the content of our websites gleich.de and cnc.gleich.de with IONOS SE, Elgendorfer Str. 57, 56410 Montabaur (hereinafter ‘IONOS’). When you visit our website, IONOS collects various log files, including your IP addresses. For further details, please refer to IONOS’s privacy policy:

The use of IONOS is based on Article 6(1)(f) of the GDPR. We have a legitimate interest in ensuring that our website is displayed as reliably as possible. Where consent has been sought, processing takes place exclusively on the basis of Article 6(1)(a) of the GDPR and Section 25(1) of the TTDSG, insofar as the consent covers the storage of cookies or access to information on the user’s device (e.g. device fingerprinting) within the meaning of the TTDSG. The content of our online shop is hosted by dc AG, Von-Linde-Str. 11, 95326 Kulmbach.

The use of dc AG is based on Article 6(1)(f) of the GDPR. We have a legitimate interest in ensuring that our online shop is presented as reliably as possible. Data processing on behalf of a client

We have entered into a data processing agreement (DPA) with the relevant companies for the use of the above-mentioned services. This is a contract required under data protection law, which ensures that they process the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

4.2. SSL encryption

To protect the security of your data during transmission, we use state-of-the-art encryption methods (e.g. SSL) via HTTPS.

Your data will not be passed on to third-party companies or organisations without your consent. Any transfer of data takes place exclusively within the framework of commissioned data processing, i.e. where responsibility for the processing remains with GLEICH Aluminium GmbH.

6.1. Webanalyse

Google Analytics

We use Google Analytics, a web analytics service provided by Google LLC (‘Google’), on the basis of our legitimate interests (i.e. our interest in the analysis, optimisation and commercial operation of our online service within the meaning of Article 6(1)(f) of the GDPR). Google uses cookies. The information generated by the cookie regarding users’ use of the online service is generally transmitted to a Google server in the USA and stored there. Google will use this information on our behalf to evaluate users’ use of our online service, to compile reports on activity within this online service and to provide us with further services relating to the use of this online service and internet usage. In doing so, pseudonymous user profiles may be created from the processed data. We only use Google Analytics with IP anonymisation enabled. This means that users’ IP addresses are truncated by Google within Member States of the European Union or in other signatory states to the Agreement on the European Economic Area. The IP address transmitted by the user’s browser is not combined with any other data held by Google. You can prevent cookies from being installed by deleting existing cookies and opting out of the storage of cookies for web analytics in our Cookie Consent Tool. Google Tag Manager

This website uses Google Tag Manager. This service allows website tags to be managed via a single interface. Google Tag Manager merely implements tags. This means that no cookies are used and no personal data is collected. Google Tag Manager triggers other tags, which in turn may collect data. However, Google Tag Manager does not access this data. If deactivation has been carried out at domain or cookie level, it remains in effect for all tracking tags, provided these are implemented using Google Tag Manager.

6.2. Onlinemarketing

Google Ads

We use the online marketing service Google Ads, a service provided by Google Ireland Limited, Google Building Gordon House, Barrow St, Dublin 4, Ireland (hereinafter referred to as “Google”), to place adverts in the search results of the Google advertising network so that they are displayed to users who are likely to be interested in the adverts. This enables us to display adverts for and within our online offering in a more targeted manner, so as to present users only with adverts that potentially match their interests. We receive an individual ‘conversion cookie’, which expires after 30 days. The information collected via the cookie is used by Google to generate conversion statistics for us. However, we are only provided with the anonymous total number of users who clicked on our advert and were redirected to a page tagged with a conversion tracking tag. We do not receive any information that can be used to personally identify users. We use Google Ads for marketing and optimisation purposes, in particular to display adverts that are relevant and of interest to you, to improve campaign performance reports, and to ensure a fair calculation of advertising costs. This also constitutes our legitimate interest in the processing of the aforementioned data by the third-party provider. The legal basis is Article 6(1), first sentence, point (f) of the GDPR. You can prevent the installation of cookies by deleting existing cookies and refusing the storage of cookies for advertising purposes in our Cookie Consent Tool. You can also prevent cookies from being stored by configuring your web browser to block cookies from the domain ‘www.googleadservices.com’ (https://www.google.de/settings/ads). Microsoft Ads

For our online marketing, we also use the online marketing service Microsoft Ads, a service provided by Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-6399, USA (hereinafter referred to as “Microsoft”), to place adverts in the search results of the Bing advertising network so that they are displayed to users who are likely to be interested in the adverts. This enables us to display adverts for and within our online offering in a more targeted manner, so as to present users only with adverts that potentially match their interests. 6.3. Plugins and embedded functions

We incorporate functional and content elements into our online service which are sourced from the servers of their respective providers. These may include, for example, graphics, videos or city maps.

Google Fonts

This page uses Google Fonts, which are hosted locally, to ensure consistent font display. No connection is made to Google and no data is transmitted to Google.

Google Maps 

This website uses Google Maps (API) provided by Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (“Google”). Google Maps is a web service for displaying interactive (land) maps to present geographical information visually. By using this service, our location is displayed to you, making it easier for you to find your way here. You must explicitly consent to the Google Maps being displayed; only then will they be loaded. The reason for this is that, as soon as you access the Google Maps, information about your use of our website (such as your IP address) is transmitted to Google’s servers and stored there, and this may also involve a transfer to the servers of Google LLC in the USA. This occurs regardless of whether Google provides a user account through which you are logged in or whether a user account exists. If you are logged in to Google, your data will be directly associated with your account. If you do not wish your data to be associated with your Google profile, you must log out before activating the button. Google stores your data (even for users who are not logged in) as usage profiles and analyses them. Friendly Captcha

Our website uses the Friendly Captcha service. This service is provided by Friendly Captcha GmbH, Am Anger 3-5, 82237 Wörthsee, Germany. Friendly Captcha is an innovative, privacy-friendly security solution designed to make it more difficult for automated programmes and scripts (so-called ‘bots’) to use our website. To this end, we have integrated Friendly Captcha’s code into our contact forms. In doing so, your IP address is recorded by Friendly Captcha in order to send a cryptographic task to your device. This task is solved in the background and, as soon as it is solved, Friendly Captcha sends a confirmation to the server that the user is a natural person.

Friendly Captcha processes and stores the following data:

• Anonymised IP address of the requesting computer
• Information about the browser and operating system used
• Anonymised counter per IP address for managing the cryptographic tasks
• The website from which the access took place.

The data is used exclusively for the purposes of protection against spam and bots, as described above. Friendly Captcha does not set or read any cookies on the visitor’s device. IP addresses are stored only in hashed (one-way encrypted) form and do not allow us or Friendly Captcha to identify any individual. The legal basis for this processing is our legitimate interests in protecting our website against unauthorised access by bots, including protection against spam and attacks (e.g. mass enquiries), in accordance with Article 6(1)(f) of the GDPR. YouTube-Videos with enhanced data protection

We have embedded YouTube videos on our website. We use YouTube’s ‘No Cookies’ feature, which means we have enabled enhanced privacy settings; videos are accessed via youtube-nocookie.com rather than youtube.com. YouTube provides this service itself and thereby ensures that YouTube does not initially store any cookies on your device. However, when you access the relevant pages, your IP address and the additional data specified in section 4 are transmitted, thereby revealing, in particular, which of our web pages you have visited. This information cannot, however, be linked to you if you are permanently logged in to YouTube or another Google service whilst accessing the page.

As soon as you start playing an embedded video by clicking on it, YouTube’s enhanced privacy mode ensures that only cookies that do not contain any personally identifiable data are stored on your device, unless you are currently logged in to a Google service. These cookies can be prevented by adjusting your browser settings or using browser extensions.
